The Promoter – The promoter is Laya Healthcare Ireland - A company registered in Ireland with Company Number : 242048 and Registered Offices located at Eastgate Road, Eastgate Business Park, Little Island, Co. Cork (the “Promoter”).
Eligibility Criteria –.This competition ("Competition") is open to persons who are (i) aged 18 years or over (ii) who are resident in the Republic of Ireland (iii) have children enrolled in participating pilot schools (iv) have completed ALL three surveys but excluding all employees or agents of the Promoter and their families.
How to Enter - Persons may enter the Competition by completing the three surveys, before the Closing Date. Only entries that are made in accordance with these terms and conditions will be eligible to take part in the Competition. The Promoter accepts no responsibility should persons be unable to enter the Competition for any reason. Only one entry per eligible family will be accepted. The Promoter reserves the right to disqualify any Entrant for any reason whatsoever in its sole discretion.
Closing Date – The Competition will run from (8th September 2014) (“Opening Date”) until (18th May 2015) (“Closing Date”). Survey 1 must be completed between 8th September 2014 and 10th November 2014; Survey 2 must be completed between 1st December and 22nd December 2014; Survey 3 must be completed between 4th May 2015 and 18th May 2015. The Promoter reserves the right to alter the Opening Date and the Closing Date. The Promoter accepts no responsibility for any delay or failure in the submission of entries or for any entry which is not received by it before the Closing Date for any reason. The Promoter accepts no responsibility for any entry, which due to a technical error or any other reason, is not received or is delayed. Proof of submitting an entry is not proof that the entry has been received by the Promoter. Only fully completed entries which are received by the Promoter in accordance with these terms and conditions and which contain the fully completed three surveys will be eligible for the Competition.
Terms of Participation – Entrants are deemed to have accepted these terms and conditions by participating in the Competition.
The Prize – The prize offered will be the opportunity to create a plan under our “Create Your Scheme” section on the Promoter’s website (“Prize”). The Prize is valid on any date up to (30th June 2016). The Prize will not be valid after (30th June 2016). For the avoidance of doubt the Prize will entitle the Prize Winner to create their own health insurance scheme under the “Create Your Scheme” section on the Laya Healthcare website. The limits of the prize are a maximum of €5000 Euro coverage and is limited to a family with a maximum of two adults (over 18 years of age) and five children (up to 18 years of age). The duration of the Prize, after a scheme has been created by the Prize winner and is deemed to come within the limits of the Prize shall be one year from the date of entering the scheme with the Promoter. The Promoter shall have no liability to the Prize Winner in the event that the Prize cannot be availed of before (30th June 2016.) The Prize Winner is required to contact the Promoter directly to arrange redemption of the prize. The Prize is non-transferrable and cash will not be offered as an alternative to the Prize. The Promoter reserves the right to offer alternative prizes of equal or greater value should the advertised Prize become unavailable for any reason or where circumstances dictate. The Promoter reserves the right to alter the dates on which the Prize Winner may avail of the Prize should the advertised dates become unavailable for any reason including unforeseen circumstances outside the Promoter's reasonable control. The Prize Winner will be bound by the terms imposed by any third parties providing goods and/or services as part of or in connection with the Prize.
Selection of the Prize Winner – The Prize Winner will be selected at random by a draw conducted by the Promoter. An independent observer will supervise the draw. The draw will take place on (15th June 2015). All eligible entries which contain the correct eligibility criteria to the Competition and all other relevant details which have been received by the Promoter before the Closing Date will be included in the draw. The decision of the Promoter as confirmed by the independent observer is final and correspondence will not be entered into with any Entrant. The Prize Winner will be notified by Post on or before (30th June 2015). The Prize will be utilised by the Prize Winner by creating their own scheme using the “Create Your Scheme” option on the Laya Healthcare Website only and by no other means on or before (30th June 2016). The Promoter will not be liable in the event that the Prize is lost, stolen or damaged including for the avoidance of doubt where the Prize does not reach the intended destination through the postal system.
Miscellaneous –The Promoter cannot accept responsibility for the acts or omissions of third parties. The Promoter shall not be liable to any Entrant or Prize Winner for any loss or damage howsoever caused, whether direct, indirect or consequential (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the Competition and/or the Prize other than death or personal injury caused by negligence of the Promoter and/or the Promoter’s respective personnel and/or deceit or fraud by the Promoter and/or the Promoter’s respective personnel.
The Promoter reserves the right to withdraw, cancel, suspend or amend the Competition or the terms and conditions of the Competition, with no liability to any Entrants, the Prize Winner or any third party.
By entering the Competition, Entrants acknowledge that they may be required to be used in publicity without further consent or payment. The name and county of the Prize Winner will be displayed on the Promoter’s website for a reasonable period of time after the Prize Winner has been selected. The Prize Winner is deemed to have consented to the publication of his/her name by participating in the Competition.
The following terms which are used in the terms and conditions have the following meaning: the term “we” or “us” means the Promoter; “you” “your” or “Entrant” means a person who participates in the Competition under the terms and conditions of the Competition; “Entry” means completing the three surveys, complying with eligibility criteria and terms and conditions of the Competition and is the combination of all these fields that must be completed by an Entrant on the competition in order for an Entrant to enter the Competition; and “Prize Winner” means the person who wins the Prize under the terms and conditions of the Competition.
Governing Law & Jurisdiction – The Competition and these terms and conditions are governed by Irish Law. Any dispute arising out of or in connection with this Competition shall be dealt with exclusively by the Courts of Ireland.
Data Protection – The Promoter respects your privacy rights. We will make use of and process the personal data (which includes your name and contact details) you provide in connection with the Competition to the extent and for the time necessary to run this Competition. By participating in the Competition you consent to the processing of your personal data as described above. In connection with these purposes, information may be shared, both inside and outside the European Economic Area, with other Laya Healthcare companies, with third parties such as data processors and our service providers such as those to whom we outsource certain business operations, and as required by law. Where you have given consent for additional uses of your information when entering the Competition your details may be used for such purposes for 12 months. Where you have given consent for additional uses of your information in connection with your policy your details may be used for such purposes during your policy term and for 12 months after that policy has ceased. Where you have given consent for additional uses of your information when receiving a quotation your details may be used for such purposes for 12 months after you receive a quote.
